Overview of the course:
This is an essential study day for healthcare practitioners led by
Prosecution Solicitor Mr. Colum J. Smith
Clinical negligence is a growing field, it encompasses many streams of medicine and cannot be ignored by
anyone providing healthcare at any level, be it private or NHS. However, the practical effects of law in
medicine are often an area that is overlooked in favour of academic training.
The law and how it applies on a day to day basis in working practice in fact forms part and parcel of most
healthcare professionals’ everyday jobs, but is often not looked at in a legal context. Briefings in an A & E
Department protocols, NICE guidelines are just as much part of the legal principles as the Data Protection Act
or the Access to Health Records Act 1990.
Some of the topics to be covered will include:
- Consent to Treatment
- The requirements for valid consent and effective communication
- Legal Issues
- Healthcare and professional duty of care, Legal Position and Bolam Defence
- Professional Issues
- Clinical responsibility, accountability and codes of professional conduct
- Documentation and Record Keeping
- Data protection, confidentiality and incident statements
